Environmental Law

Wulfsberg Reese Colvig & Firstman brings its unique expertise in the construction, insurance and real estate fields, as well as its outstanding litigation and business capabilities, to the increasingly contentious area of environmental law. We assist real estate developers and investors, engineering firms, remediation contractors, construction firms, manufacturers and industrial companies, insurance companies, and local government agencies in dealing with their environmental legal and regulatory problems.

We advise clients on all aspects of environmental law and regulation, including compliance with air, water, and hazardous materials regulations. We have considerable experience in the prosecution and defense of claims for environmental cleanup costs and related insurance coverage matters. Our attorneys have assisted clients in resolving complex disputes involving Superfund sites, CERCLA response costs, and toxic tort personal injury actions.

We have also represented numerous purchasers and sellers of industrial facilities and commercial properties impacted by environmental matters. We provide advice and transactional assistance on the investigation and remediation of environmentally affected sites. We also advise clients on the structuring of corporate and real estate transactions to allow for the evaluation of environmental risks and responsibilities under federal and state law.

We represent an owner of two former copper mines in Redding, California concerning acid mine drainage in Lake Shasta, under jurisdiction of the Regional Water Board.

In responding to the California Department of Toxic Substances Control requirements and multi-party litigation, we represent a multi-national chemical company former owner of contaminated site on which the Los Angeles Unified School District has constructed a $54 million middle school.  One of our principals served as the Chairperson of the PRP Group responsible for investigating and remediating the site.

We represented a former manufacturer of landing gear assemblies in defending complex litigation involving contribution of contaminated waste to a former landfill and municipal incinerator site in Pomona, California.

We represented a major Northern California City and its Community Redevelopment Agency in negotiations with diverse parties to bring about the redevelopment of a contaminated 62-acre former industrial site under Federal Court jurisdiction.  Our involvement included negotiations and assistance to the Court Overseers for the project, negotiations and preparation of contracts for the environmental remediation contractor, and negotiations with the insurer concerning appropriate language and coverage for cost cap and pollution liability insurance policies.

We represented a school district in environmental due diligence and contract negotiations concerning the district’s acquisition of an environmentally impaired property for use as a bus maintenance facility.
